Govt’s CAT Jurisdiction Order Will Create Hardships For J&K Employees: Kashmir Lawyers’ Body

 

Srinagar, April 30: Kashmir High Court Bar Association on Thursday said central government’s order by virtue of which all aggrieved employees of J&K are henceforth supposed to approach Central Administrative Tribunal (CAT) in Chandigarh for redressal of their grievances would create hardships.

As spokesman of the lawyers’ body said that its Executive committee in its ‘teleconferencing meeting’ took note of issuance of notification by the central government providing for exercise of jurisdiction over the service matters by Chandigarh bench of the administrative tribunal.

The association said it would inconsequence result in filing of the fresh service matters before the service tribunal located at Chandigarh and transfer of all pending service matters in the high court of Jammu and Kashmir there.

“The issuance of notification will result in multiple hardships for the employees who seek dispensation of justice,” the lawyers’ body said, as per statement.

“The location of the tribunal at Chandigarh would generally deprive all classes of employs from getting their grievances redressed due to incurring of heavy expenses in proceeding to Chandigarh and hiring legal services would be beyond their means outside J&,” the spokesman said, adding, “it which would result in complete denial of the right to approach the court for ventilation of their grievances.”

The Bar members suggested to impress upon the authorities to provide circuit benches for dealing with service matters at Srinagar so as to mitigate the sufferings of service class.

The lawyers’ body impressed upon the concerned authorities to take appropriate remedial measures providing for constitution of circuit benches for J&K and Ladakh. (GNS)
