President delegates powers to LG Ladakh to exercise powers & functions of State Govt

Srinagar, May 09: The President of India has empowered the Lieutenant Governor of Ladakh to exercise the powers and functions of the State Government under two central laws within the Union Territory.

The Union Home Ministry has issued two separate notifications to delegate powers to the LG Ladakh under two central laws.

According to a notification, a copy of which is in the President of India has directed that the powers and functions of the State Government under several provisions of the Indian Partnership Act shall be exercised by the Lieutenant Governor of the Union territory of Ladakh within the UT.

“In pursuance of the power conferred under clause (1) of article 239 of the Constitution, the President hereby directs that the powers and functions of the State Government under section 56, sub-section (1) of section 57, sub-section (3) of section 58 and sub-sections (1) and (2) of section 71 of the Indian Partnership Act, 1932 (9 of 1932) shall, subject to the control of the President and until further orders, be exercised by the Lieutenant Governor of the Union territory of Ladakh within the Union territory of Ladakh,” reads the notification.

Similarly, the President of India has also authorized LG Ladakh to exercise the powers and functions of the State Government under the Dentist Act.

“In pursuance of the power conferred under clause (1) of article 239 of the Constitution, the President hereby directs that the powers and functions of the State Government under the Dentist Act, 1948 (16 of 1948) shall, subject to the control of the President and until further orders, be exercised by the Lieutenant Governor of the Union territory of Ladakh within the Union territory of Ladakh and the rules made thereunder,” reads another notification.
