Govt asks Admin secretaries to incorporate automatic cancellation clause in appointment orders

Srinagar, June 18: The administration of Union Territory of Jammu and Kashmir has asked the administrative secretaries to incorporate automatic cancellation clause in the appointment order of a recruit if he or she fails to join within the stipulated time period of 21 days.

In an official order, Government has brought to fore of the departments a circular has already been issued in this regard last year. But some departments are still not adhering to the instructions leading to delay in cancellation of appointment.

“Vide Circular No. 08-JK (GAD) of 2019 dated 04.12.2019, it has been impressed upon the Administrative Secretaries to incorporate a standard condition of automatic cancellation of appointment, in the appointment order of a recruit, in the event he/she fails to join within the stipulated period of 21 (twenty one) days,” reads the order.

The order states that it has been observed that despite issuance of circular instructions some departments are still not adhering to the instructions leading to delay in cancellation of appointments.

“As a corollary to it, the departments fail to operate the waiting list within the stipulated time period and take up the matter with General Administration Department for revalidation of waiting list which is not in consonance with the governing rules. This also leads to avoidable administrative complicacies and litigations,” it reads.

The order further stated the circular instruction regarding inclusion of standard condition of automatic cancellation of appointment in the appointment orders is reiterated as the candidates who fail to join within a period of 21 (twenty one) days from the date of issuance of the appointment order shall forego their right to appointment which shall be deemed to have been cancelled abinitio without any further notice.”

“All the Administrative Secretaries are once again impressed upon to incorporate the above clause as a standard condition in all the appointment orders as may be issued by the departments or their heads of departments or subordinate offices,” the order states.
