SRINAGAR: The Government of Jammu and Kashmir, under the aegis of the Revenue Department, has approved the allocation of Five Marla of state land on a lease basis to eligible beneficiaries of the Pradhan Mantri Awas Yojana (Gramin).

This decision aims to address the housing needs of the landless population in the region.

The allocation covers various categories of landless individuals, including those currently residing on State land, Forest land, Rakhs and Farms, individuals in possession of Custodian land, and residents on land near Dachigam Park allocated by the Government for agricultural purposes where construction is not permitted. Additionally, this initiative extends to other eligible beneficiaries without access to land for construction.

 

The order defines Landless PMAY (G) beneficiaries listed in the Permanent Waiting List 2018-19, as surveyed by the Ministry of Rural Development, Government of India, and meeting all eligibility criteria for housing assistance under PMAY (G)/Awas plus, are eligible for land allocation.

Land will be granted on a lease basis in accordance with the Jammu and Kashmir Land Grants Act of 1960 and the Rules made thereunder. Beneficiaries will pay a one-time premium of Rs 100/- per marla and an annual ground rent of Rs 01/- per marla per annum, the order reads.

Initially, the lease will be for 40 years, extendable for another 40 years, contingent on fulfilling all formalities. However, failure to construct a house on the allotted land within two years will lead to lease cancellation.

The official order outlines the responsibilities of Deputy Commissioners in overseeing the allocation process, with specific guidelines.

As per the order, “To be classified as landless, an individual must be a domicile of Jammu and Kashmir, have a separate family, and not possess land in their name or in the name of any family member, nor be entitled to inherit 5 marlas or more of land.”

The verification process will be conducted by the Assistant Commissioner (Development) of the Rural Development Department, including confirming AADHAAR details. Tehsildars will conduct inquiries, identify state land, and verify beneficiary details, including landless status. In cases where the beneficiary has shifted from another district, a report from the previous district of residence will be obtained to confirm their landless status.

Tehsildars will also submit complete cases, along with essential documents such as Jamabandi, Girdawari, Tatima/Shajra Kat, Ration Card, an affidavit from the beneficiary confirming landlessness, and statements from Lambardar & Chowkidar.

It’s important to note that the land allocation does not automatically grant permission for construction. Lessees must seek approval from the competent authority for house construction.

Lessees are obligated to use the land only for the granted purpose and initiate construction within three months from the lease date. Failure to do so will result in the land reverting to the government without compensation. Sub-leasing or transferring the leased land is strictly prohibited, with contravention leading to lease termination.

Tehsildars will execute the lease agreements with lessees using the Form-1 provided. The Deputy Commissioner will maintain a monthly database of all such leases, which will be submitted to the Government.
